Zilok.com is the exclusive property of Zi Group SA.
The term ‘user’ refers to all physical or moral persons who access the site, whether they are a member or not.
The term ‘member’ refers to all physical or moral persons who have signed-up on the site in order to make use of its services.
The term ‘member account’ refers to the private space on the site reserved for each member. It is accessible via password and contains member details, including private contact information.
The term ‘owner’ refers to all members who put a certain item up for rent, according to the procedures required by Zilok.com.
The term ‘renter’ refers to all members who take an item out for rent on the site.
The term ‘rental contract’ refers to the agreement made between the owner and the renter that creates the obligation for the owner to transfer use of the object (about which the contract pertains), and creates the obligation for the renter to give a financial payment of a certain amount which is either pre-determined, or defined in the contract.
The term ‘price’ denotes the financial payment given to the owner by the renter in order to gain use of the object.
The term ‘rental listing’ refers to the information published by the owner outlining the item that is for rent.
The term ‘booking request’ refers to a request made by a renter to an owner to reserve the item of a rental listing for a certain period of time.
The phrase ‘acceptance of the reservation request’ refers to the online acceptance by the owner of the rental offer claim made by the renter, and thus confirms the rental contract for a given item between that owner and that renter.
The term ‘retainer fee’ refers to the amount charged in advance to the renter to confirm his booking request.
1. Terms for Rental Agreements
Co-contractors declare that they are legally entitled to pursue these actions before completing a rental on Zilok.com.
The user who wishes to offer an item and/or product up for rent on the site, declares that they are legally entitled to pursue these actions, and declares that they have full legal capacity and all authorizations required. Any persons labeled as legally incapacitated, as defined by the civil code, can under no circumstances rent or put an item and/or product up for rent on the site. Any use of the site and the Services offered becomes the responsibility of that user’s legal representative, and said legal representative is bound to respect the present stipulations. When personal details are provided, the legal representative must fill out the registration form themselves, or expressly authorize the person whom they represent to do so, with all stipulations regarding personal information that follow below being applied therein.
The price of each product and/or item presented on Zilok.com is expressed in British Pounds. It is a price which includes all taxes (when applicable) as well as any other costs, excluding possible delivery fees and extra insurance costs.
With the exception of promotional offers that are explicitly outlined on the site www.zilok.com, fees are charged to the owner for the listing of rental offers (insertion fee), as well as commissions once a rental agreement is confirmed between a renter and an owner.
Access, registration and use of the site are free.
Zilok can modify its policies on listings and commission fees, and can also modify the fees set for these services. Modifications, be they temporary or permanent, are effective as soon as they appear online and are applicable to all translations undertaken from that moment onwards. In the case of temporary modifications, the duration of the changes will be clearly indicated on the site.
As an owner, you must pay fees whenever you list items online for rent, and whenever a booking request is confirmed through your account on Zilok.com. The fees for these two kinds of transactions are in accordance with the information provided below in clauses a. and b.
The following values are the prices before any applicable taxes.
a. Online Listings / Rental Listing Fees (Insertion fee)
Listing fees are £0.10 per month and per item. Billing is run once every quarter, for the whole quarter duration, and starts the first day of publication for each item.
Rental listings fees are FREE until 2010 for members joining before April 2009.
b. Commissions on Transactions (transaction fee)

3. Billing & Payment
There are different methods for payment and invoicing on Zilok.com.
a. Retainer fee
Confirmation of a reservation request by a renter may be dependent on payment of a retainer fee. This retainer fee is charged by Zilok in the name of and to the account of the owner, as a partial advance payment on the total transaction amount for the rental. The retainer fee is also equal to the commission due by the owner to Zilok for the transaction (transaction fee) in accordance with the tables and information outlined above.
The services provided by Zilok to facilitate and enable the rental transaction remain free for the renter, as the retainer fee paid by the renter will be deducted from the total transaction amount due by the renter to the owner. The owner agrees to these terms when accepting this Pricing policy.
A proof of payment of this retainer fee is always available via the renter’s member account under the section My Bookings.
The retainer fee is charged from the renter's account only if the corresponding rental reservation request is accepted by the owner.
Payment of the retainer fee can be made online via credit card, a ClickandBuy account or a Paypal account.
Invoicing information and billing payment are available online in the "My Bills" section of your member account. The invoices history is available online in your member account(My Invoices section within My Bills). The Member explicitly accepts this process for receiving invoices.
When you choose automatic payment of your online bills, you can set how frequently invoices get published in your member account area.
Invoices corresponding to listing fees will be sent directly to the 'My Invoices' section of your account when the rental listing is published online.
Once the item is published online on the website through your member account, the listing fees are due and an invoice is sent to your member account, accessible in the section 'My Invoices'. The invoices for listing fees correspond to the online publication of your rental listing for a period of 3 months. These fees are due again and an invoice is automatically sent out if the item is still being published online after this 3 months period. If the rental listing is not published online anymore at the end of the aforementioned period, no more invoices will be sent out for this item to your member account.
An email message reminding you about the listing fee renewal will be sent 7 days before expiration of the aforementioned 3 months publication period. At the end of the 3 months publication period you will also be reminded in the welcome menu of your member account.
In no case may the listing fees be cancelled or modified pro rata, in particular in situations where a member account has been terminated and/or cancelled.
You always have the possibility of removing the online rental listing for a particular item during its 3 months period of validity, or to pause the rental listing.
When a rental listing is deleted from your account before the end of the 3 month listing period, the current listing fee is still valid for the full 3 months period and future listing fees invoice renewals are automatically cancelled .
If a rental listing is deleted, or not renewed at the end of the 3 months listing period, the publication of a new rental listing corresponding to the same item will be subject to new listing fees and a new 3 months listing period will begin.
The pause function (which keeps a rental listing online but does not allow reservation requests) does not stop or discontinue the listing period for which listing fees are due.
Reactivation of an item that is being paused before does not incur any extra costs.
If an invoice has not been paid within the required timeframe, your rental listing will be paused until the invoice has been settled.
In cases where the commission is paid directly by the owner, via an invoice to his member account, this commission is due from the owner by the end of the rental period that was agreed upon by the owner and the renter at the latest. In these cases, the invoice will be sent for each transaction at latest by the last day of the rental.
c. Payment Method
There are two payment methods available to members:
- Credit card
Payment are made bu clicking on the button “Pay My Invoices” in the “My Invoices” section of your account.
d. Payment Due Dates
Payments of invoices issued by Zilok are due within 30 calendar days of their issuance date.. If a payment is not made by its due date, late fees will be applied to the member account.
e. Payment Default and Late Fees
Late fees start being applied if an invoice has not been paid 30 calendar days after being issued.
In case of payment default on amounts due to Zilok.com, a formal notice will be sent and billed to the Client.
If the default invoices remain unpaid following the formal notice, the amounts due will accrue late fees interest at a yearly rate of 12%. A penalty fee of 15% of the total due will also be applied, which will be added to the fees for the formal notice, and any other costs related to the recovery of the due amounts.
During these procedures for recovering unpaid invoice amounts, the debtor will be held responsible for all the fees, legal or non-legal, without prejudice of all demands and damages and interest and other actions, including contentious ones, necessary to safeguard the interests of Zilok.com.
In addition, the member explicitly accepts that Zilok.com may partially or completely suspend his account and corresponding services until due payments are recovered. Zilok may proceed with the deactivation of service(s) which will be billed at the current applicable rate. The user will be able to use the services again once the amount due has been settled, and when payment of any amounts due in advance is made.
If the user does not resolve the situation before the end of the month following suspension of services, Zilok will have the full right to cancel the contract without any further actions being taken. The fees for due amounts recovery will however remain the responsibility of the user. Zilok reserves the right to not reinstate a user whose account remained debtor during the course of a previous contract.
You can print your invoices by clicking on an invoice in the “My Invoices” section and clicking on “Print Invoice”.g. Payment
An invoice must be paid within 30 days of when it was issued to the member account on Zilok.com.
It is possible to set up automatic payments of your invoices at regular intervals by contacting Zilok through the Contact Us ticket system.
Zilok has set a minimum amount of £1 under which the member does not have to pay the invoice. An invoice will be issued online as soon as the minimum amount is reached by member transactions.
4. Fees & Tax
Users and members of the site are accountable for all the taxes, fees and commissions resulting from use of our services and our Internet site. Zilok takes no responsibility for these taxes applied to any transactions that take place on the site.
Taxes (such as, and without limitations, sales taxes) may be applied to your transactions whether you are a moral (company) or physical (individual) person, and/or whether you are an owner or a renter. Members explicitly recognize and accept that these taxes may be applicable to their situation, in accordance with the current legislation.
Cancellation of a reservation request or of a rental can be done within the member account.
The renter has the possibility to cancel a reservation request before it has been accepted or declined by the owner, at no cost. If a retainer has been requested by the owner, this amount will not be charged to them when such a cancellation occurs.
Once a rental request has been accepted by an owner, the renter still has the option to cancel the rental and the corresponding rental contract, in accordance with the rental agreement laid out by the owner. However, if a retainer fee has already been charged, the renter cannot be reimbursed for it.
If a rental transaction is cancelled by the owner after having been previously accepted, the renter can appeal to this situation by contacting Zilok directly via the Contact Us button.
Zilok reserves the right to accept or refuse any member appeal.
6. Appeals and Invoice Disputes
All appeal claims must be submitted by creating a ticket at the Contact us tab.
7. Guarantees & Responsibility
Zilok makes every effort to offer you the best service possible. However, Zilok cannot be held responsible for not fulfilling its contractual obligations in the face of unpredictable and/or force majeure events, in accordance with applicable laws and jurisprudence.
Zilok is responsible for all direct and foreseeable damages that may occur during usage of the site. Under no conditions may Zilok be held responsible for any loss or alteration of data, loss of profit and/or business accounts/time/opportunities or any other indirect loss, be it through negligence or any other cause for the loss or damage in question.
If the member or user is a consumer, the rights accorded to them by law are not put in question by the present clause.
8. Proof of Transactions
The computerized records kept within Zilok’s electronic data system, and maintained using reasonable security measures, will be considered as proof of the communications, orders and payments made between parties.
9. Applicable Laws
Zilok will do its best to attain an amiable resolution in all disputes. If you are not satisfied with the method by which a dispute is resolved, and if you wish to make an appeal to a qualified tribunal, the following rules will apply.
The contract is regulated by Belgian Law. Each party accedes exclusive capacity regarding all litigation to the capacity of the Brussels Tribunal (Belgium).
